I’ve been following the Apple – Samsung courtroom drama like it’s the 3rd season of Games of Thrones. The litigation started July 30 and will end on August 24, where U.S. District Judge Lucy Koh expects a jury deliberation to start on that date as well.
A lot has happened since the start of the case and a lot of secret have been spilled, specially those from Apple.
Apple is accusing Samsung for copying the “trade dress” of the iPhone and iPad. Trade dress is a legal term of art that generally refers to characteristics of the visual appearance of a product or its packaging (or even the design of a building) that signify the source of the product to consumers. Apple is also asking Samsung to pay $2.5 billion in damages for violating their “Trade Dress” IP and a number of iOS features and potentially confusing customers into thinking that their (Samsung) product is an Apple product (or was it the other way around?).
While Samsung is asking $519 million from Apple from allegedly infringing 5 Samsung patents that are used on Apple’s iOS devices namely the iPod touch, iPhone and iPad.
From what have been reported already, everything will rest on the jury deliberation and whoever will win this case will surely affect each others business as well as the whole mobile/tablet industry. I’m not gonna tell who I think will win but I still think (and hope) that a settlement can still be work out between Apple and Samsung, since $2.5 billion is too big for Samsung to pay and even though Apple have a shit-load of cash there’s no way Apple will be paying Samsung that $519 million without a fight.
What people need to remember is that no matter what happens in the case Samsung will still be an important Apple partner, since Samsung manufactures a number of important components of iOS devices (iPhone, iPad and ipod touch) and even though we do not know which company will triumph, the lawyers from both-sides will surely collect one of the biggest pay-check in their “lawyering” career.
